These Terms of Use (“Terms”) govern your access to and use of the website https://rivanawomenshealth.ca and any related virtual services (the “Platform”), operated by RiVana Health Inc. (“RiVana,” “we,” “us,” or “our”).

By accessing or using our Platform, booking appointments, or creating an account, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform or services.
Important Notice: Our services may not be appropriate for all health concerns. RiVana Health Inc. does not provide emergency or crisis services. If you are experiencing an emergency, call 911 or go to the nearest emergency department.
1. Our Services
RiVana Health Inc. provides virtual healthcare services for women, which may include general health support, menopause care, weight management support, and related services.
Services may include:

Virtual consultations with licensed healthcare providers in Canada

Clinical support and care planning within the provider’s scope of practice

Laboratory and diagnostic coordination

Specialist referrals where appropriate
Telehealth services are delivered remotely via secure text, audio, or video platforms.
These services do not replace your primary care provider. We encourage all patients to maintain an ongoing relationship with a primary care provider and to keep them informed of care received through RiVana Health Inc.
2. Eligibility
To use the Platform and services, you must:

Be at least 18 or 19 years of age, according to the age of adulthood in your province

Be a resident of Canada

Complete registration and any required intake processes
We reserve the right to refuse, suspend, or terminate access if eligibility requirements are not met.
3. User Responsibilities
You agree to:

Provide accurate, complete, and current information

Use the Platform only for personal, non-commercial purposes

Follow guidance provided by your healthcare provider

Seek in-person or emergency care when advised or necessary
You are responsible for all activity under your account and must keep login credentials secure.
4. Telehealth Services & Clinical Limitations
Healthcare providers delivering services through RiVana Health Inc. are independent licensed professionals and are not employees of RiVana Health Inc.
Availability and scope of services depend on your province or territory and applicable regulatory requirements.
Providers may decline, limit, or discontinue services at their professional discretion.
Telehealth Risks
You acknowledge that telehealth has inherent limitations, including potential:

Technical or connectivity issues

Delays in communication
-
Limitations in assessment compared to in-person care
By using telehealth services, you accept these risks.
5. Payments and Fees
Fees apply for services not covered by provincial health insurance plans.
Payment must be made in advance using accepted payment methods.
Fees are non-refundable unless otherwise stated in writing.
RiVana Health Inc. reserves the right to update fees with reasonable notice.
6. Acceptable Use, Conduct, and Right to Refuse Service
RiVana Health Inc. is committed to providing care in a safe, respectful, and professional environment for patients, clinicians, and staff.
We reserve the right, at our sole discretion, to refuse, suspend, or terminate access to the Platform or services, with or without notice, where a user engages in conduct that is abusive, harassing, threatening, or otherwise inappropriate.
Prohibited conduct includes, but is not limited to:

Abusive, aggressive, discriminatory, or threatening language or behaviour toward staff, clinicians, or representatives of RiVana Health Inc.

Harassment, intimidation, or repeated unwanted contact, including excessive messaging or attempts to pressure staff or providers

Demands for care or services that fall outside clinical judgment, professional standards, or scope of practice

Misuse of communication channels, including sending repeated messages after boundaries have been communicated

Submission of false, misleading, or incomplete information
-
Conduct that compromises the safety, well-being, or integrity of staff, clinicians, or operations
Where safety concerns arise, services may be discontinued immediately. In such cases, we may, where appropriate, provide information regarding alternative care options.
Violation of this section may result in immediate suspension or termination of access to services or the Platform.
7. Intellectual Property
All content, trademarks, branding, and materials on the Platform are owned by or licensed to RiVana Health Inc. and are protected under Canadian intellectual property laws.
You may access content for personal use only. Reproduction or distribution without written permission is prohibited.
8. Limitations of Liability & Indemnification
The Platform and services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free service.
To the fullest extent permitted by law:

RiVana Health Inc. is not liable for medical, financial, technical, or data-related outcomes arising from use of the Platform

You agree to indemnify and hold harmless RiVana Health Inc., its officers, contractors, and providers from claims arising from your use of the Platform or breach of these Terms
Nothing in these Terms limits liability where such limitation is prohibited by law.
9. Privacy
Personal information is collected, used, and disclosed in accordance with our Privacy Policy and applicable Canadian privacy legislation, including PIPEDA.
10. Dispute Resolution
These Terms are governed by the laws of Canada and the Province of Ontario, without regard to conflict of law principles.
In the event of a dispute, parties agree to attempt good faith resolution prior to initiating formal proceedings. Where permitted by law, disputes shall be resolved through binding arbitration in Ontario.
11. Amendments
We may update these Terms from time to time. Continued use of the Platform following any changes constitutes acceptance of the revised Terms.
